First of off, thank you for taking the time to even read this. I fell about 20 feet while working at a pool service job. It occured on the first day of work. I was told to climb rocks up to a jacuzi. I had no training in anything and it was the first site of the day. It was pouring rain outside. I slipped on the rocks and fell a long ways down landing on another bed of rocks. I landed on my head , then my chest and eventually my back hit these rocks. I was out of work reacing workers comp checks for about 2 weeks when they sent me back to work. The doctor that the company send me to go see sent me back to early. I told him that I was still in agony. ON the day I went back to work i was supposed to be on LITE DUTY yet i was forced to lift huge power washers and other equiptment. I imedietly called my superviser when i felt a horrible pain in my back. I now have 2 bulding discs. I am going to theropy 3 times a week for 3 mnths. What are my chnces of winning a law suit?
Your question is specialized, and is affected by your state law, your employment contract, and a physical exam by your own doctor. You have enough justification to talk to a personal-injury / workmen's comp lawyer. Be sure to get one who specializes, and look for one who doesn't require payment unless he/she wins for you (except you will have to pay court costs and other fees by law). Then, be sure he/she is seeking enough damages to cover what you need covered. (Lawyers who charge only if they win normally get a higher percentage than usual of the damages award.)
Your question doesn't say if you are being paid and having your medical expenses covered. If not, lost income and medical expenses would be additional potential damages, if they are being covered already, of course they reduce potential damages you would be entitled to if you won a lawsuit.
